TaleWater Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") are an agreement between you and TaleWater LLC, a Washington limited liability company ("TaleWater," "we," "us," or "our"), governing your use of the TaleWater mobile application and its related services, including sharing pages (together, the "App"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

Our Privacy Policy explains how we handle personal information. Please read it. The Privacy Policy is referenced in these Terms but is not incorporated into this contract; your privacy rights and our privacy commitments are set out in that policy and in applicable law.

2. Who can use TaleWater

TaleWater is offered to users in the United States. You must be at least 13 years old to use TaleWater. By using the App, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

4. What TaleWater does — and its limits

TaleWater is a voice-journaling and location-logging tool for recreational fishing. It uses your voice recordings, an AI processing pipeline, and (if you enable it) your device's location to build a personal fishing journal.

TaleWater is not a safety, navigation, or emergency service. Do not rely on TaleWater for real-time navigation, weather safety decisions, or any situation where inaccurate location data, a missed recording, a transcription error, or an AI-generated summary could put you or anyone else at risk. Water conditions, weather, and wildlife carry inherent real-world risk that TaleWater does not assess or warn you about beyond the informational weather data described in our Privacy Policy.

AI-generated content may contain errors. Transcripts, extracted observations, and generated summaries are produced by automated speech-recognition and AI systems and may misinterpret, omit, or incorrectly summarize what you actually said or observed. Review journal entries before relying on them.

5. Recording other people

TaleWater's voice-capture feature records ambient audio, which may pick up other people's speech. You are solely responsible for complying with all applicable recording-consent, wiretapping, and privacy laws in the places you use TaleWater, including obtaining any consent required from people who may be recorded. Some states, including Washington, require everyone in a private conversation to agree before it is recorded. TaleWater is not a party to, and assumes no responsibility for, your compliance with those laws. See the "Recordings and transcripts" heading in Section 2 of our Privacy Policy for more detail on how recording works.

6. Your content and fishing knowledge

Your content remains yours. You retain your rights in your recordings, transcripts, journal entries and other content you submit. These Terms do not transfer ownership of that content to TaleWater.

Permission to operate and improve TaleWater. You grant TaleWater a nonexclusive permission to store, reproduce, process, adapt, transmit and display your content only as reasonably necessary to provide the App, carry out the quality evaluation and product improvement described in the Privacy Policy, develop the generalized fishing knowledge described below, and carry out sharing you expressly choose. We may allow service providers to perform those functions for us, subject to the applicable protections described in the Privacy Policy. This permission is subject to your privacy choices, applicable law and the retention and deletion limits in that policy. It does not authorize selling your personal content, advertising uses or enrollment in provider general-purpose model-training programs.

Later changes. The Privacy Policy explains and limits the uses permitted here. A later policy revision does not, by itself, expand this content permission. Any proposed expansion will be addressed through the Terms-change process in Section 12 and any required notice, acceptance or separate privacy consent before that use begins.

Private spots and generalized knowledge. We may derive generalized fishing knowledge and recommendations for TaleWater users across waters, broad regions or water types. We do not expose your private fishing spots, GPS tracks or saved locations to other users or the public unless you choose to share them. Knowledge retained independently of your journal must not reasonably identify you or reveal your private fishing locations, directly or through combinations of details. We maintain that knowledge in deidentified form and do not attempt to reidentify contributors. Our permission to keep and use generalized knowledge that meets these conditions survives deletion of your content or account and any termination of these Terms. This does not authorize retaining the deleted source content, identifiable examples, private coordinates or links that reconnect the knowledge to them. If you export or download deidentified information from TaleWater, you agree to keep it in deidentified form and not attempt to identify its contributors or reconstruct their private fishing spots.

Sharing you choose. When you enable sharing, you authorize TaleWater to display the selected content through the sharing feature. Review what a link will show, including locations, before enabling it. Anyone with a public link can view and forward it. A link does not expire and cannot be switched off separately; sharing ends when you delete the shared content. We disable access through our sharing service as part of deleting the shared content. We cannot recall copies independently saved by recipients. Sharing permission does not give recipients ownership of your content.

Deletion and the end of this permission. When you delete content or your account, we promptly stop ordinary quality reuse of the affected identifiable content after receiving and, where needed, verifying the deletion instruction. Any continuing permission is limited to carrying out the deletion process and the limited retention or legal obligations described in the Privacy Policy. We do not use the deletion period to create new independently retained knowledge from that content. Restricted recovery copies are not used for ordinary product improvement. Generalized knowledge that already meets the conditions above may remain under those conditions; source deletion does not permit preserving or recreating an identifiable example.

Rights in submitted content. Submit only content you have the necessary rights and permissions to provide. Do not use TaleWater to violate another person's privacy, recording rights or other legal rights. Any permissions required to record others remain your responsibility, as described in Section 5 and the Privacy Policy.

8. Subscriptions and payment

TaleWater offers optional paid features through auto-renewing subscriptions purchased in the App through Apple's App Store. The subscription name, length and price are shown in the App before you buy. Payment is charged to your Apple account when you confirm the purchase.

Subscriptions renew automatically for the same length and at the then-current price unless you cancel at least 24 hours before the end of the current period. You manage and cancel subscriptions in your Apple account settings, not in the App. Deleting your TaleWater account does not cancel an Apple subscription, and cancelling a subscription is never a condition of exercising a privacy right. Refund requests are handled by Apple under Apple's policies.

If we raise a subscription price, we will give you the notice Apple requires before the increase applies, and you can cancel before it takes effect. Any free trial or promotional offer is described where it is offered and converts to a paid subscription at the end of the trial unless cancelled. We may change the features included in a subscription with reasonable notice.

9. Termination

You may stop using TaleWater and delete your account at any time. We may suspend or terminate your access to the App if you violate these Terms, if we reasonably believe your use poses a risk to TaleWater, other users, or third parties, or if we discontinue the App. We'll make reasonable efforts to notify you before termination except where we believe advance notice would create a safety, legal, or security risk. Sections 6 (as to surviving permissions), 10, 11 and 13 survive termination.

TALEWATER IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT LOCATION, TRANSCRIPTION, OR AI-GENERATED CONTENT WILL BE ACCURATE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TALEWATER AND ITS OWNERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Changes to the App and these Terms

We may modify or discontinue features of the App at any time. We may update these Terms from time to time; if we make material changes, we will notify you through the App or by other reasonable means before the change takes effect, and where the change expands the content permission in Section 6 or otherwise requires your agreement under applicable law, we will ask you to accept it before it applies to you. Continued use of the App after other changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws principles.
